These Terms of Service govern your use of the Rentgara platform. By accessing or using our services, you agree to be bound by these terms. Rentgara is a peer-to-peer rental marketplace — we facilitate connections between item owners and renters but are not a party to individual rental agreements. Please read these terms carefully before using our platform.

1 acceptance of terms

By creating an account, accessing, or using the Rentgara platform (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Rentgara ("we," "us," or "our"), a platform operated from Kathmandu, Nepal.

2 definitions

The following terms have specific meanings throughout these Terms of Service:

  • "Platform" or "Service" — the Rentgara website, mobile application, and all related tools, features, and services operated by Rentgara.
  • "User" — any individual who creates an account on or accesses the Platform, whether as an Owner, Renter, or both.
  • "Owner" — a verified User who lists one or more personal items available for rent on the Platform.
  • "Renter" — a verified User who books and rents items from an Owner through the Platform.
  • "Listing" — an item posted on the Platform by an Owner, including its description, photographs, pricing, availability, and rental terms.
  • "Booking" — a confirmed reservation of a Listing for a specified Rental Period, agreed upon by both the Owner and Renter.
  • "Rental Period" — the duration from the scheduled pickup time to the scheduled return time as specified in a Booking.
  • "KYC" (Know Your Customer) — the mandatory identity verification process requiring a valid government-issued ID and selfie photograph before a User may transact on the Platform.
  • "Service Fee" — the commission charged by Rentgara on each completed transaction, disclosed to both parties before Booking confirmation.
  • "Content" — any text, images, photographs, reviews, messages, or other materials uploaded or submitted by Users to the Platform.

3 eligibility

To use Rentgara, you must:

  • Be at least 16 years of age. Users between 16 and 18 must have parental or guardian consent.
  • Provide truthful, accurate, and complete registration information.
  • Complete identity verification (KYC) with a valid government-issued ID before engaging in any transaction.
  • Have the legal capacity to enter into binding agreements under the laws of Nepal.

4 description of service

Rentgara is an online peer-to-peer marketplace that enables users to list personal items for rent ("Owners") and to discover and rent items from other users ("Renters"). We provide the technology platform, payment facilitation, and communication tools to connect Owners and Renters.

Rentgara is not a party to rental transactions. The rental agreement is solely between the Owner and the Renter. We do not own, manage, or control any items listed on the platform. We are not an agent, insurer, or guarantor for either party.

5 user accounts & security

You are responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your login information.

You may not create multiple accounts, use another person's account, or transfer your account to any third party without our written consent. We reserve the right to suspend or terminate accounts that violate these Terms.

6 owner obligations

As an item Owner on Rentgara, you represent and warrant that:

  • You have legal ownership or authorization to rent out the listed items.
  • All listing descriptions, photographs, and pricing are accurate, complete, and not misleading.
  • Items are in safe, functional condition and free from undisclosed defects.
  • You will honor confirmed bookings and make items available as agreed.
  • You are solely responsible for any applicable taxes on income earned through the platform.

7 renter obligations

As a Renter on Rentgara, you agree to:

  • Use rented items responsibly, with reasonable care, and in accordance with any instructions provided by the Owner.
  • Return items on time and in the same condition as received, subject to normal wear and tear.
  • Promptly report any damage, loss, or malfunction to both the Owner and Rentgara.
  • Bear financial responsibility for any damage to or loss of rented items during the rental period, as determined through our dispute resolution process.

8 payments, fees & refunds

All payments are processed through integrated third-party payment providers (including eSewa and Khalti). Rentgara charges a service fee on each completed transaction, which is disclosed before confirmation.

Owner payouts are released after the rental period concludes and the Renter confirms receipt in satisfactory condition, or after a 48-hour grace period, whichever comes first.

Refund eligibility is determined on a case-by-case basis and subject to our Cancellation Policy and dispute resolution procedures. Service fees may be non-refundable.

9 cancellation & disputes

Cancellation by Renter: Free cancellation is available up to 24 hours before the scheduled pickup time unless the listing specifies otherwise. Late cancellations may result in partial charges.

Cancellation by Owner: Owners who cancel confirmed bookings may be subject to penalties, including reduced visibility of their listings and potential account restrictions.

Dispute Resolution: In the event of a dispute, both parties agree to first attempt resolution through Rentgara's mediation process before pursuing any external legal action. We will review evidence from both parties and make a determination within a reasonable timeframe.

10 prohibited items & conduct

You may not use Rentgara to:

  • List or rent items that are illegal, stolen, counterfeit, hazardous, or prohibited under Nepal law.
  • Provide false, misleading, or fraudulent information in listings, communications, or verification documents.
  • Circumvent the platform's payment system to avoid service fees or conduct off-platform transactions.
  • Harass, threaten, discriminate against, or harm other users in any way.
  • Use bots, scrapers, or automated tools to access or interact with the platform without authorization.

Violation of these prohibitions may result in immediate account suspension or permanent ban, at our sole discretion.

11 trust & safety measures

Rentgara implements the following safety protocols to maintain a trusted community:

  • Mandatory KYC verification: Every User must complete identity verification with a valid government-issued ID and selfie photograph before listing or renting any item. All KYC submissions are reviewed by our team before approval.
  • Right to reject or revoke verification: We reserve the right to reject KYC applications, revoke verified status, or suspend accounts at any time if we suspect fraudulent documents, identity misrepresentation, or behavior that threatens community safety.
  • Secure payments: All transactions are processed through regulated third-party payment providers. Funds are held in escrow during the Rental Period and released only upon successful completion.
  • Reporting & moderation: Users may report suspicious Listings, fraudulent behavior, or safety concerns. We investigate reports and take action including content removal, account suspension, or referral to law enforcement where appropriate.

While we take reasonable measures to verify Users and maintain platform safety, these measures do not constitute a guarantee of any User's identity, trustworthiness, or the condition of any Listing. Users are encouraged to exercise their own judgment.

12 damage, loss & liability between users

Responsibility for items rests with the parties involved in the transaction, not with Rentgara. Specifically:

  • During the Rental Period, the Renter assumes responsibility for the rented item(s). Any damage, loss, or theft occurring during this period is the Renter's financial responsibility.
  • The Owner is responsible for ensuring items are in the described condition at the time of handover. Undisclosed defects or misrepresentation may result in the Owner bearing liability.
  • Both parties are encouraged to document item condition (photographs, video) at pickup and return. Such evidence may be used in dispute resolution.
  • Rentgara may facilitate mediation between parties in the event of a damage or loss dispute, but we are not an insurer or guarantor. Any compensation determined through mediation is paid by the responsible party, not by Rentgara.

Rentgara is not liable for any item damage, loss, theft, personal injury, or property damage arising from transactions between Users. By using the Platform, you acknowledge and accept this allocation of risk.

13 limitation of liability

To the maximum extent permitted by applicable law, Rentgara and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or personal property, arising out of or in connection with your use of the Service.

Without limiting the foregoing, Rentgara expressly disclaims liability for: (a) the conduct, actions, or omissions of any User; (b) the quality, safety, legality, or availability of any Listing; (c) any damage to or loss of items during a Rental Period; (d) any personal injury or property damage arising from User interactions; and (e) any failure by a User to perform their obligations under a Booking.

Our total aggregate liability to you for any claims arising from the Service shall not exceed the total amount of Service Fees you have paid to Rentgara in the 12 months preceding the claim.

14 indemnification

You agree to indemnify, defend, and hold harmless Rentgara and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any dispute between you and another user.

15 intellectual property

The Rentgara name, logo, website design, and all related trademarks, service marks, and content are the exclusive property of Rentgara. You may not reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

By posting content on the platform (including listing photos and descriptions), you grant Rentgara a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely in connection with the operation and promotion of the Service.

16 termination

You may terminate your account at any time by contacting us or using the account deletion feature. We reserve the right to suspend or terminate your account without prior notice if you violate these Terms or engage in conduct that is harmful to other users, third parties, or Rentgara.

Upon termination, any pending transactions will be handled in accordance with our standard procedures. Sections relating to Limitation of Liability, Indemnification, and Governing Law shall survive termination.

17 governing law & jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Nepal, including the Electronic Transactions Act, 2063 (2008) and the Consumer Protection Act, 2075 (2018). Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.

18 modifications to these terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email notification or a prominent notice on the platform at least 15 days before taking effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
